The Supreme Court has ruled border officers do NOT need clear and convincing evidence that a green card holder committed a crime before reclassifying them as an applicant for admission.

SCOTUS ruled 6-3 today in Blanche v. Lau. Justice Thomas authored. Jackson dissented. Resolves a three-circuit split.

What this means: a pending charge at the border is enough to trigger the reclassification. The conviction can come later, in removal proceedings.
