Harvey Weinstein is heading back to court in New York for a new trial over sex crimes after his previous conviction was overturned.

The former Hollywood mega-producer is poised to appear in a New York City courtroom on Tuesday for the start of his retrial.

The trial comes nearly a year after New York’s highest court overturned the 73-year-old Hollywood figure’s 2020 rape and sexual assault conviction, ruling that the judge who presided over the case made “egregious errors.”

Harvey Weinstein won a legal victory in his rape and sexual assault retrial in Manhattan, as his pleas to get out of the “hell hole” he calls Rikers Island were granted by the judge.

The former Hollywood power broker will be transferred from the infamous New York City lockup to Bellevue Hospital, a judge ruled Thursday. Weinstein will be allowed to stay at the Kips Bay hospital until the conclusion of the trial.

Manhattan District Attorney Alvin Bragg’s office did not immediately respond to a request for comment.

Weinstein, 73, was brought into a Manhattan courtroom in a wheelchair on Wednesday, dressed in a dark suit and navy tie. He has pleaded not guilty to two counts of first-degree criminal sexual act and one count of third-degree rape. He could face decades more in prison if convicted.

The new trial before state Supreme Court Justice Curtis Farber is expected to last roughly six weeks. Manhattan District Attorney Alvin Bragg attended the start of the retrial.

Former movie mogul Harvey Weinstein was convicted Wednesday of one of the top charges in his sex crimes retrial but acquitted of another, and jurors were as yet unable to reach a verdict on a third charge.

The split verdict meted out a measure of vindication to his accusers and prosecutors — but also to Weinstein — after the landmark case was thrown into limbo.

Weinstein’s initial conviction five years ago seemed to cement the downfall of one of Hollywood’s most powerful men in a pivotal moment for the #MeToo movement. But that conviction was overturned last year, and the case was sent back for retrial in the same Manhattan courthouse.

This time, a majority-female jury convicted the former studio boss of forcibly subjecting one to a criminal sex act in 2006.

But jurors acquitted Weinstein of another criminal sex act charge from 2006. And jurors were to continue deliberating on a charge that he raped another woman in 2013. Under New York law, the third-degree rape charge carries a lesser penalty than the first-degree criminal sex act offense.
