A Colorado appeals court has OVERTURNED the nine-year prison sentence of former Mesa County Clerk Tina Peters, while upholding her underlying conviction.
Peters was convicted for allowing an associate of MyPillow unauthorized access to election software in an attempt to find evidence of 2020 election fraud.
The court ruled that the sentencing judge violated Peters' First Amendment rights by factoring her beliefs about election fraud into the sentence, stating: "Her offense was not her belief...in the existence of such election fraud; it was her deceitful actions in her attempt to gather evidence of such fraud."
The case will be sent back to a lower court for resentencing. President Trump announced a pardon for Peters in December, though Colorado officials argued he lacked jurisdiction over state charges.
Colorado Secretary of State Jena Griswold responded that Peters "should not receive any special treatment" during resentencing.

Tina Peters will be FREE!
That fat POS Colorado Gov. Jared Polis (D) has commuted Tina Peters’ nine-year prison sentence to 4.5 years.
She will be released on parole on June 1st.
