Big win on immigration front in First Circuit -- maybe the most liberal federal appeals court. 3-0 decision affirming the discretionary authority of the Sec. of DHS to terminate en masse the "parole" status of individuals granted parole entry by the Biden Admin.

Parole comes with no status. The legal status is the same as if the person was simply detained and held at the border.

The DHS Sec. has complete discretion to determine when the justification for granting parole comes to an end. At that point the status reverts back to non-admission without further INA process or rights.

Between 2022 and 2025, the Biden Admin used parole status to allow entry into the US by more than 500,000 Cubans, Haitians, Nicaraguans, and Venezuelans.

The Trump Admin. terminated parole for all of them 60 days after he took office.

A district judge in Massachusetts said that such terminations had to be a on a case-by-case basis -- so more than 500,000 separate decisions.

First Circuit said, "Nope, en masse terminations are within DHS Sec. discretion."
